PORT CHARLOTTE, Fla. — A 67-year-old Florida grandfather is accused of shooting his 38-year-old granddaughter to death after she was banging on his door during an apparent outburst.
Jose Mogro, 67, is facing a charge of aggravated battery with a deadly weapon, according to an arrest affidavit from the Charlotte County Sheriff’s Office.
The shooting happened around 3:27 a.m. on Saturday, March 1, deputies said. Mogro’s granddaughter, Maria Rangel had just moved to Florida from Texas to stay with him and her grandmother to help “get her life back on track.”
According to the affidavit, Mogro and the grandmother said Rangel suffered from bipolar disorder, smoked marijuana and was recently behaving aggressively. And, they added her behavior had been “escalating” the longer she stayed with them.
On Feb. 28, the 38-year-old left her grandfather’s home in an Uber before returning around 2 a.m. on March 1, deputies said.
“The victim was being loud, making noises slamming doors and keeping them awake,” deputies stated in the affidavit.
After ignoring a request to be quiet, Mogro reportedly locked the door to his master bedroom “because he did not feel safe based on how the victim was acting.”
Twenty minutes later, Rangel started banging on the master bedroom door, prompting the grandfather to arm himself with a gun.
Mogro reportedly opened the door to find Rangel “swinging her arms and approaching him quickly.” The 67-year-old later told deputies that he fired the gun while stepping backward, striking his granddaughter in the chest.
Deputies learned that Rangel posed no real threat to Mogro during the incident, leading them to develop probable cause to arrest him for aggravated battery with a deadly weapon.
